Legal
Services supports the mission of Edmonton Catholic Schools by providing
legal services to The Board of
Trustees of Edmonton Catholic Schools, the office of the Superintendent
of Schools, Superintendent's
Council, Superintendent's
Services, School Operations
Services, Leadership Services,
and the Department Services in the following areas of law as they
relate to educational and legal matters:
access to information, administrative law, Charter of Rights,
commercial law, computer law, constitutional law, construction
law, disciplinary law, education law, employment law, health law,
human rights law, intellectual property law, labour law, municipal
law, real property law, tort law and workplace health and safety
law.
Specific areas of responsibility of District legal counsel are:
- Act in accordance with the Access to District Legal Counsel Protocol;
- Provide sound legal advice and opinions as requested and as required;
- Draft/review contracts, leases, and other agreements and review
existing District contracts as required or as requested;
- Where required, interpret statutory and regulatory provisions
to recommend proactive practices for District operations;
- Make legal representations on behalf of the District before
the courts and administrative tribunals when required;
- Liaise with School Operations Services on school-related issues of a legal nature as well as plan
and implement the monthly Law with Lunch sessions;
- Develop materials and in-service training on specific issues as required;
- Act as liaison with all outside legal counsel who may occasionally be retained by Edmonton
Catholic Schools. All legal issues from central office and schools are to be brought to the attention
of and discussed with District Legal Counsel, who serves as the District contact for any matters
which are to be handled by outside legal counsel.
- Acts as a liaison with the public and outside agencies on legal matters concerning Edmonton
Catholic Schools.
In accordance with the Access to District Legal Counsel Protocol,
when school administrator has a legal issue and/or question, he/she
is to first discuss same with School Operation Services, a Department
Director or, where appropriate, the Superintendent of Schools, who
would then instruct District legal counsel to work with the school
principal on that issue.
